Data collection on this website
Who is responsible for the data collection?
The data processing on this website is carried out by the website operator. You can find their contact details in the section „Information on the controller“ in this privacy notice.
How do we collect the data?
Your data is collected, on the one hand, by you providing it to us. This may be, for example, data that you enter into a contact form.
Other data is collected automatically or with your consent by our IT systems when you visit the website. This is primarily technical data (e.g. internet browser, operating system or time of the page view). This data is collected automatically as soon as you enter this website.
What do we use the data for?
Part of the data is collected in order to ensure error-free provision of the website. Other data may be used to analyse your user behaviour.
What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you can withdraw this consent at any time with effect for the future. In addition, you have the right to request the restriction of the processing of your personal data under certain circumstances. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.
You can contact us at any time regarding this as well as any further questions on the subject of data protection.
Hosting
External hosting
This website is hosted by an external service provider (host). The provider is Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA (Cloudflare Pages). The personal data collected on this website is stored on the host’s servers. This may primarily involve IP addresses, contact requests, meta and communication data, contract data, contact data, names, website accesses and other data generated via a website.
The host is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 Abs. 1 lit. b DSGVO (GDPR)) and in the interest of a secure, fast and efficient provision of our online offering by a professional provider (Art. 6 Abs. 1 lit. f DSGVO). Insofar as corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 Abs. 1 lit. a DSGVO and § 25 Abs. 1 TTDSG (German Telecommunications Telemedia Data Protection Act), insofar as the consent covers the storage of cookies or access to information in the user’s terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. The consent can be withdrawn at any time.
Our host will only process your data to the extent necessary to fulfil its performance obligations and will follow our instructions with regard to this data.
The data transfer to the USA is based on the standard contractual clauses of the EU Commission and the EU-US Data Privacy Framework. You can find details here: https://www.cloudflare.com/de-de/privacypolicy/.
Processing of data on behalf
We have concluded a data processing agreement (AVV) with the above-mentioned provider. This is a contract required by data protection law which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the DSGVO (GDPR).
General information and mandatory information
Data protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy notice.
When you use this website, various personal data is collected. Personal data is data by which you can be personally identified. This privacy notice explains what data we collect and what we use it for. It also explains how and for what purpose this is done.
We point out that data transmission on the internet (e.g. when communicating by e-mail) can have security gaps. Complete protection of the data against access by third parties is not possible.
Information on the controller
The controller for data processing on this website is:
Andreas Schmidberger
Monikastraße 13
53757 Sankt Augustin
Phone: +49 172-6795078
E-mail: info@schmidberger.ro
The controller is the natural or legal person who alone or jointly with others decides on the purposes and means of the processing of personal data (e.g. names, e-mail addresses or similar).
Storage period
Unless a more specific storage period has been stated within this privacy notice, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a justified request for deletion or withdraw consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion takes place once these reasons no longer apply.
General information on the legal bases of data processing on this website
If you have consented to the data processing, we process your personal data on the basis of Art. 6 Abs. 1 lit. a DSGVO (GDPR) or Art. 9 Abs. 2 lit. a DSGVO, insofar as special categories of data pursuant to Art. 9 Abs. 1 DSGVO are processed. In the case of explicit consent to the transfer of personal data to third countries, the data processing is additionally carried out on the basis of Art. 49 Abs. 1 lit. a DSGVO. If you have consented to the storage of cookies or to access to information in your terminal device (e.g. via device fingerprinting), the data processing is additionally carried out on the basis of § 25 Abs. 1 TTDSG. The consent can be withdrawn at any time. If your data is required for the fulfilment of a contract or for the performance of pre-contractual measures, we process your data on the basis of Art. 6 Abs. 1 lit. b DSGVO. Furthermore, we process your data insofar as it is necessary for compliance with a legal obligation on the basis of Art. 6 Abs. 1 lit. c DSGVO. The data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6 Abs. 1 lit. f DSGVO. Information on the legal bases applicable in each individual case is provided in the following paragraphs of this privacy notice.
Data protection officer
As this is a purely private website, there is no legal obligation to have a data protection officer.
Information on data transfer to the USA and other third countries
Among other things, we use tools from companies based in the USA or in other third countries that are not secure under data protection law. When these tools are active, your personal data may be transferred to these third countries and processed there. We point out that a level of data protection comparable to that of the EU cannot be guaranteed in these countries. For example, US companies are obliged to disclose personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for surveillance purposes. We have no influence on these processing activities.
Withdrawal of your consent to data processing
Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out up to the withdrawal remains unaffected by the withdrawal.
Right to object to data collection in special cases and to direct advertising (Art. 21 DSGVO)
IF THE DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6 ABS. 1 LIT. E OR F DSGVO, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY NOTICE. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 ABS. 1 DSGVO).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS CONNECTED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION PURSUANT TO ART. 21 ABS. 2 DSGVO).
Right to lodge a complaint with the competent supervisory authority
In the event of infringements of the DSGVO (GDPR), data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged infringement. The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from „http://“ to „https://“ and by the lock symbol in your browser line.
When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Information, deletion & correction
Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to correction or deletion of this data. You can contact us at any time regarding this as well as any further questions on the subject of personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data took place/is taking place unlawfully, you can request the restriction of the data processing instead of deletion.
- If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
- If you have lodged an objection pursuant to Art. 21 Abs. 1 DSGVO, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data may – apart from its storage – only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.
Data collection on this website
Cookies
Our websites use so-called „cookies“. Cookies are small text files and do not cause any damage to your terminal device. They are stored on your terminal device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your terminal device until you delete them yourself or until they are automatically deleted by your web browser.
In some cases, cookies from third-party companies may also be stored on your terminal device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services).
Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies serve to evaluate user behaviour or to display advertising.
Cookies that are necessary to carry out the electronic communication process, to provide certain functions you have requested (e.g. for the shopping cart function) or to optimise the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6 Abs. 1 lit. f DSGVO (GDPR), unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, the processing is carried out exclusively on the basis of this consent (Art. 6 Abs. 1 lit. a DSGVO and § 25 Abs. 1 TTDSG); the consent can be withdrawn at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.
Insofar as cookies from third-party companies or for analysis purposes are used, we will inform you about this separately within the scope of this privacy notice and, where applicable, request your consent.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- Browser type and browser version
- Operating system used
- Referrer URL
- Host name of the accessing computer
- Time of the server request
- IP address
This data is not merged with other data sources.
This data is collected on the basis of Art. 6 Abs. 1 lit. f DSGVO (GDPR). The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, the server log files must be collected.
Enquiry by e-mail, telephone, fax or via contact form
If you contact us by e-mail, telephone, fax or via a contact form, your enquiry including all personal data resulting from it (name, enquiry) will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.
This data is processed on the basis of Art. 6 Abs. 1 lit. b DSGVO (GDPR), insofar as your enquiry is connected with the fulfilment of a contract or is necessary for the performance of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6 Abs. 1 lit. f DSGVO) or on your consent (Art. 6 Abs. 1 lit. a DSGVO) if this has been requested; the consent can be withdrawn at any time.
The data you send to us via contact requests remains with us until you ask us to delete it, withdraw your consent to storage, or the purpose for storing the data no longer applies (e.g. after your request has been dealt with). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
Registration on the website
You can register on this website in order to use additional functions on the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise we will refuse the registration.
For important changes, such as to the scope of the offer or in the case of technically necessary changes, we use the e-mail address provided during registration to inform you in this way.
The data entered during registration is processed for the purpose of carrying out the user relationship established by the registration and, where applicable, for initiating further contracts (Art. 6 Abs. 1 lit. b DSGVO (GDPR)).
The data collected during registration is stored by us for as long as you are registered on this website and is subsequently deleted. Statutory retention periods remain unaffected.
Plugins & tools
YouTube with extended data protection
This website embeds videos from YouTube. The operator of the pages is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.
We use YouTube in extended data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the extended data protection mode does not necessarily rule out the passing on of data to YouTube partners. For example, YouTube establishes a connection to the Google DoubleClick network – regardless of whether you watch a video.
As soon as you start a YouTube video on this website, a connection to YouTube’s servers is established. The YouTube server is thereby informed which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.
Furthermore, after starting a video, YouTube may store various cookies on your terminal device or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve user-friendliness and prevent attempted fraud.
Where applicable, further data processing operations may be triggered after the start of a YouTube video, over which we have no influence.
YouTube is used in the interest of an attractive presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6 Abs. 1 lit. f DSGVO (GDPR). Insofar as corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 Abs. 1 lit. a DSGVO and § 25 Abs. 1 TTDSG, insofar as the consent covers the storage of cookies or access to information in the user’s terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. The consent can be withdrawn at any time.
You can find further information on data protection at YouTube in their privacy notice at: https://policies.google.com/privacy?hl=de.
Google Fonts (local hosting)
This site uses so-called Google Fonts, provided by Google, for the uniform display of fonts. The Google Fonts are installed locally. No connection to Google servers takes place in this process.
You can find further information on Google Fonts at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://policies.google.com/privacy?hl=de.
Social media
Data processing by social networks
We maintain publicly accessible profiles on social networks. The individual social networks we use can be found below.
Social networks such as Facebook, Twitter etc. can generally analyse your user behaviour comprehensively when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). Numerous processing operations relevant to data protection are triggered by visiting our social media presences. In detail:
If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, under certain circumstances your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection takes place, for example, via cookies that are stored on your terminal device or by recording your IP address.
With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. If you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are logged in or have been logged in.
Please also note that we cannot trace all processing operations on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. Details on this can be found in the terms of use and data protection provisions of the respective social media portals.
Legal basis
Our social media presences are intended to ensure the most comprehensive presence possible on the internet. This constitutes a legitimate interest within the meaning of Art. 6 Abs. 1 lit. f DSGVO (GDPR). The analysis processes initiated by the social networks may be based on different legal bases, which are to be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 Abs. 1 lit. a DSGVO).
Controller and assertion of rights
If you visit one of our social media presences (e.g. Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. In principle, you can assert your rights (information, correction, deletion, restriction of processing, data portability and complaint) both against us and against the operator of the respective social media portal (e.g. against Facebook).
Please note that, despite the joint responsibility with the social media portal operators, we do not have full influence over the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.
Storage period
The data collected directly by us via the social media presence will be deleted from our systems as soon as you ask us to delete it, withdraw your consent to storage, or the purpose for storing the data no longer applies. Stored cookies remain on your terminal device until you delete them. Mandatory statutory provisions – in particular retention periods – remain unaffected.
We have no influence on the storage period of your data that is stored by the operators of the social networks for their own purposes. For details on this, please obtain information directly from the operators of the social networks (e.g. in their privacy policy, see below).

Audio & video conferences
Data processing
Among other things, we use online conference tools for communication with our customers. The individual tools we use are listed below. If you communicate with us by video or audio conference via the internet, your personal data will be collected and processed by us and by the provider of the respective conference tool.
The conference tools collect all data that you provide/use in order to use the tools (e-mail address and/or your telephone number). Furthermore, the conference tools process the duration of the conference, the start and end (time) of participation in the conference, the number of participants and other „contextual information“ in connection with the communication process (metadata).
Furthermore, the provider of the tool processes all technical data required for handling the online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker as well as the type of connection.
Insofar as content is exchanged, uploaded or otherwise made available within the tool, this is also stored on the servers of the tool providers. Such content includes in particular cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information shared during the use of the service.
Please note that we do not have full influence over the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. Further information on the data processing by the conference tools can be found in the privacy notices of the respective tools used, which we have listed below this text.
Purpose and legal basis
The conference tools are used in order to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 Abs. 1 lit. b DSGVO (GDPR)). Furthermore, the use of the tools serves the general simplification and acceleration of communication with us or our company (legitimate interest within the meaning of Art. 6 Abs. 1 lit. f DSGVO). Insofar as consent has been requested, the tools concerned are used on the basis of this consent; the consent can be withdrawn at any time with effect for the future.
Storage period

Stored cookies remain on your terminal device until you delete them. Mandatory statutory retention periods remain unaffected.
We have no influence on the storage period of your data that is stored by the operators of the conference tools for their own purposes. For details on this, please obtain information directly from the operators of the conference tools.
